By now most of us know that StormPay and NetIBA were incorporated by the SAME person. Mr. John McConnell Jr is the registered agent, the principal officer, and the customer service contact of NetIBA. This man is also the registered agent of Stormpay. Steven Girsky is the CEO and Customer Service contact for StormPay. According to google maps: Map Link, they live 168 ft apart; it takes about 4 seconds to get from one house to the other.

If you have a complaint about NetIBA, before filing with the BBB, you should contact John Mcconnell at (931) 905-0112. If you reverse search this number at www.whitepages.com, you find it belongs to NetIBA at 1690 Golf Club Lane, Clarksville, TN 37043.

Who owns 1690 Golf Club Lane you ask? This 2 story, 6,068 sq ft, 30 office building is owned by John R. Mcconnell! Imagine that!

No, you're not seeing double, NetIBA is at the same address as StormPay, in the building owned by John McConnell. The only difference is the phone number.

My question: is it legal to call a business owner at home? Of course, you are almost certain to lose your account, rather than get anything resolved so I wouldn't recommend it! Additionally, according to the BBB, Steven Girsky is a lawyer working for Batson, Nolan, Brice, Harvey, & Williamson. However, Steven Girsky is not listed on their web page: www.bnbwg.com. Nor is he listed as a member of the Tennesee Bar Association. I don't dare speculate on this and anyone else inclined to do so should cease and desist!

Looking back at the Tennesee property records, I looked up S. Third St to see who owns the building where Steven is/was a lawyer. It's owned by BNBWG Realty. Hmm, Could those letters stand for Batson, Nolan, Brice, Williamson, & Girsky? Doing a search on google tells me I am correct. However, the BBB doesn't have a record of this company and the address is the same address as the attorney's office address. I guess BNBWG Realty doesn't do much business?

Finally, according to the BBB, Stormpay has "an unsatisfactory record due to a pattern of complaints received. In the past 36 months, the company has received complaints specifically concerning the company's failure to inform and follow up with its customers when it suspends accounts, failure to release funds in a timely manner and failure to resolve complaints directly with company management. The company has responded to each complaint presented by BBB. However, the company has not eliminated the pattern of complaint. The BBB Definition of pattern: - More than 2 complaints involving the same allegations usually within 12 months that are significant in relation to the company's size and volume of business. YTD 2006, the company has received 8 complaints; in 2005, the company received 49 complaints; in 2004, the company received 6 complaints.

The proof is in the pudding folks. For all practical purposes, StormPay and NetIBA are the same company. Don't be ripped off by them!

A natural association of two enterprises involved in
dirt track racing turned into a business alliance
Friday when StormPay.com became the primary sponsor of
Clarksville Speedway.

StormPay.com — a payment processing company for online
auctions — and the speedway agreed to a two-year deal,
with an option for an additional two-year sponsorship.
Financial terms were not disclosed, but Steve Girsky,
CEO of StormPay.com, said sponsorship dollars will
allow the renamed Clarksville StormPay.com Speedway to
continue its expansion and renovation, while
increasing the cash awarded to race winners.

Girsky and speedway owners William and Tammy Scogins
began discussions about the business venture two weeks
ago. StormPay.com is the primary sponsor of the Crate
Racin’ USA Series, which has grown from a regional
dirt racing event into a national racing series in
only one year.

StormPay.com’s involvement in the speedway, a
clay-oval dirt track on Needmore Road, is a separate
business deal from its sponsorship of the racing
series.

“Anything and everything we do out here will be
focused around StormPay.com,” William Scogins said.
“It’s a great handshake that we’ve been able to find
somebody in our own town, in our community that’s
going to take interest in racing the way they’ve had.”

StormPay.com’s involvement with the speedway also
includes the Friday night drag racing series and the
go-cart track.

The speedway is undergoing its most extensive
renovation since the Scoginses bought the facility
five years ago. Corporate suites and a new media tower
are under construction.

Before StormPay.com became the primary sponsor of the
Crate Racin’ USA Series, CEO Steve Girsky admits he
wasn’t much of a racing fan.

Now, he can’t watch enough racing, and the company he
helped launch four years ago has increased its impact
on the local racing scene.

StormPay.com — a payment processing company for online
auctions — became the primary sponsor of Clarksville
Speedway, the 40-year-old dirt track that launched the
career of Clarksville’s Jeff Purvis, and is the
central track for the launch of the Crate Racin’
Series, which has grown from a regional racing event
into a national series.

The two-year deal, with an option for an additional
two years, became official when Girsky and speedway
owners William and Tammy Scogin made the venture
officially known Friday.

With StormPay.com having its headquarters in
Clarksville, becoming the primary sponsor of the
clay-oval dirt track was an ideal fit.

“Truthfully, the sponsorship of our local track in the
hometown of our corporate headquarters was a natural
extension of our racing endeavors of what we’ve
undertaken in the past year,” Girsky said.

StormPay.com, which was launched in 2002, does
business in 200 countries and is expanding its
services to include e-mail accounts, Web pages, domain
registry and Web-based tools.

With this major sponsorship endeavor, the Clarksville
StormPay.com Speedway is positioned to speed up its
current expansion and renovation, while providing
bigger purses for the Crate Racin’ USA Series.

“We haven’t ear-marked money for any particular
purpose, other than set aside monies from the
sponsorship to these purses to make them bigger,”
Girsky said.

Most dirt tracks pay $400 to their winner, but the
speedway will pay its winner $800.

The new Clarksville StormPay.com Speedway is currently
building corporate suites — a first for a dirt track —
in addition to a new media and scoring tower.

“We’re trying to give the community a place to have
people come in, businesses come in, and have a place
to entertain their clients,” Tammy said. “We’re hoping
that these suites go well this year, and that maybe if
word gets out, that we can add another roll of them
next year.”

Added Girsky: “We’ve been to several (dirt tracks)
here recently and we haven’t come across one yet that
has suites.”

Last season, the speedway was the host site for 200
events — including some that weren’t race related —
and averaged 1,200 in attendance with its stock car
series.

“All these corporate businesses, from mom and pa, to
2,000 people, we can entertain out here,” Tammy said.
“We can give them a little place they can do something
at.”

Other renovations to the track facility include
replacing the fence alongside the road in front of the
track, in addition to building a new entrance and new
signs.

“It is a good venture for both companies. It’s an
asset for us we know, and we hope it’s an asset for
them,” William said. “Tammy and I have tried to
improve the place the longer we go.”

The speedway has invested $30,000 in transponders to
assist in scoring the cars and the laps they’ve run.

StormPay.com will also help drivers find corporate and
business sponsors to cover the costs of their
operation.

“For these guys, it costs a lot of money to race and
expand the base of the sport,” Girsky said. “If we can
get sponsorship for the drivers, we’ve helped another
set of fans.”

StormPay.com’s interest in auto racing was initiated
after it was approached by a Nextel Cup team looking
for sponsorship. Girsky met with Purvis, who spent
nearly 20 years racing on the ARCA, NASCAR Busch and
then-Winston Cup series, to learn what would be
involved in sponsorship.

It was Purvis who tipped StormPay.com, which is the
primary sponsor of Purvis’ Crate Series car, about the
Crate engine, and its future in dirt track racing.

Motors for late model cars can cost $40,000, but the
Crate engines cost between $3,000 and $5,000, and
their speeds and horse***** are similar to those of
the more costly motors.

“This whole series is the wave of the future,” Girsky
said. “You can race a car and buy an engine from
$3,000 to $5,000 dollars, and race against
NASCAR-level competition.”

On August 7, 2003, the Tennessee Securities Division of the Department of Commerce & Insurance issued an "Order to Cease and Desist" (file number 03-020) with TymGlobal, Inc., StormPay, Inc. and John R. McConnell, Jr.

The order states that TymGlobal and StormPay are under common ownership and/or control. TymGlobal operates an internet website which is registered to StormPay. On the internet website, respondents are operating a pyramid and/or Ponzi scheme promising large returns on investments for participating in the scheme. The order further states that TymGlobal has not registered any securities offerings with the Division pursuant to Tennessee Securities Act of 1980. Nor has the company registered with the Division as a broker-dealer, agent of a broker-dealer or investment adviser. Also, the respondent StormPay has not registered any securities offerings with the Division nor has the company registered with the Division as a broker-dealer, agent of a broker-dealer, or investment adviser. John R. McConnell, Jr. has not registered with the Division as a broker-dealer, an agent of a broker-dealer or as an investment adviser.

Potential investors were given the opportunity to invest in both partnership shares as TymGlobal as well as to participate in various Ponzi schemes. Respondents promised a high return. The offering of participation in the schemes sold by the respondents is an investment contract and thus, a security under the act.

The Division ordered the respondents TymGlobal, StormPay and John R. McConnell, Jr to cease and desist the conduct of a broker-dealer in the state of Tennessee until such time as it effectively registers with the Division. The order did not intend to prohibit lawful conduct of the respondents.

Since talking to the governor’s office in Tennessee Stormpay has many complaints in the past about issues frozen accounts. i spoke with Becky Bradley and she has asked that you email any and all information to her about Stormpay wrong doing her email address is becky.bradley@state.tn.us apparently she wants to help get this resolve in a timely manner.

I wanted to let you know that there will be a statement released in the member news area within an hour with an update on communications between StormPay and 12daily Pro attornies.

It will also be posted here on scam.com.

This statement will address the resolution of the freeze on 12dp's StormPay account by attornies for both parties. It will also address the StormPay account issues many of you have experienced today.

I hope knowing a statement is coming can help relieve some of your confusion and concern.

This whole deal poses an interesting question. What about those who joined this ponzi, like the original poster and most if not all defenders on this board, full well knowing what it was? Do they even DESERVE money back? Also, in history, ponzi participants have been prosecuted and had to pay back all the money they earned. That would be unfortunate if that happened.

I also must wonder why no one complained about being paid through Stormpay before and now, that theyre helping bring autosurfs down, they suddenly care. Coincidence?

What would be unfortunate is for you to continue to go through life spreading misinformation.

Ponzis are investment schemes which provide neither a service nor a product for the money one spends.

From the 12DP TOS:

C. Upgrade payments made to 12daily Pro are considered membership fees, not investments or deposits of any kind. The money we pay members is a payment for the service provided by them, viewing other member websites.

I paid 12Daily for ad space in their rotation, and for the opportunity to have other members look at my ads. My purchase was not an investment, it was a business expense.

They supplied me with that ad space and that opportunity beginning in July, and are continuing to do so.

If you really are a "Dad", I very sincerely feel sorry for your wife and children, if you have either. I, too, am a "Dad," possibly even old enough to be your "Dad," but I would never make unjustified and irresponsible comments like yours to them or on a public forum for them to possibly see.

What you fail to realize is that many of the autosurf programs to which you refer in general were and are legitimate programs, not ponzi's as you have assumed without basis for making such assumption. Hundreds of thousands of people worldwide were being paid by these legitimate programs until Stormpay illegally, without notice or legal justification, arbitrarily closed (froze) access to the Stormpay accounts and funds belonging to these programs (not to Stormpay).

Stormpay have also since followed this illegal and unwarranted action by stealing and misappropriating funds from the Stormpay accounts of their users, as well as from their bank accounts, solely because these users received payments from one or more of these programs. Stormpay have done this without the authorizations of these users, and regardless of whether or not these users had received payments from these programs that were in excess of the monies they had paid into them.

Do your homework before you comment about matters of which you obviously know nothing!

So how about your homework. How are they NOT a ponzi? (autosurfs) And if you look through Dad's posts youll see he actually explains why they are ponzis. Unlike you who just says something as if it were fact.

I will wait for a court of law to render a judgment that the programs "Dad" has generalized and lumped together as a whole are ponzi's are such! After more than a decade online, I have been victim to ponzi's, so I am acutely aware of what they are. To generalize or categorize all programs from an industry as being ponzi's is irresponsible and not fair to the programs that are legitimate or to the people who support and prosper from them.

Regardless of the outcome of this matter, the very best of luck with your pursuit for education and may your future be bright. Your lessons in life have just begun.

Further to my above post, I must apologize as I seem to have gotten off the discussion of this thread, which I think was intended to direct attention to Stormpay's credibility and qualifications, and legal authority, or lack thereof, to unilaterally pass judgment and pursue actions in the manner it has against the get-paid-to-autosurf industry, and the personal accounts and funds of thousands of its fee paying user customers. Were any of the programs and users affected by these unilateral actions on the part of Stormpay served or presented beforehand with a court order or other legal instrument authorizing Stormpay to proceed as it did? As one of these affected users, and pertaining to my case only, I can answer this with an unequivocal no!

My understanding is, that when Ms. Charis Johnson decided to use EMO as an additional payment processor, StormPay became a little greedy and wanted all of 12 Daily Pro's business or else. (I'm not sure if it was due to the huge racetrack's renovation they're having to pay for in Clarksville or not).

StormPay got their self in a little hot ***** and realized they couldn't just freeze 12 Daily Pro's accounts without freezing all of the other autosurf programs they were hosting or they knew they could be liable for malicious intent. It is my belief that if StormPay could've froze 12 Daily Pro's accounts only, they would've done that, but StormPay had to cover up for their misconduct by freezing all of the autosurf programs which was to their own hurt.

I don't believe StormPay is responsible enough to own a payment processing business. When you can freeze 1000,s of people's accounts, then run down to the racetrack (and that seemingly is their main concern right now), they need to be stripped of everything they have.

I'm certain that all of these 1000's of people are not going to let StormPay rest until they come clean and return everyone's money. I believe that StormPay is involved in criminal activity and I don't want my funds held by these characters another day.

Nice attempt at being condescending, but its funny how I'm still in college and even I know how to stay away from a ponzi scam, while some of us haven't learned how to in ten years.

If you paid by credit card or checking account, you can get your money back in about 5 minutes and get on with your life. Just contact your bank, most banks already know the whole story and will gladly reverse the transactions.

It's sad that Carl is the only one it seems to be standing up for the truth here. The so called Ponsi definition refers to something that happened back in the 1930's before people even had televisions and most people didn't even have telephones. It should not and does not have any relationship to today's electronic communications. But it is a great excuse and underhanded legal way for dishonest, crooked lawyers, and businessmen to legally steal people's money. Just call it or make it "fit" the definition of a Ponsi scheme, and we can legally steal millions of dollars from anyone we want. Just like Stormpay stole 50 million from all of us in the 12dailypro scandal. Stormpay is owned and operated by a group of lawyers. (Check it out for yourselves). Hardly anyone among the 300,000 people who invested in 12dailypro ever complained. It was Stormpay who just decided to freeze everyones funds ("steal" would be a better word for it) Stormpay were the ones who went to the SEC. Of course once the government receives a complaint from a so called "legitimate" financial institution then Stormpay can legally steal everyones money. Stormpay knew what they were doing from the beginning. What would you expect from a bunch of lawyers? Just watch.....nothing will happen to Stormpay........as they legally get away with millions of dollars and theres nothing any of us can do about it. The only thing 12dailypro did was be very successful, and the only thing Stormpay did was successfully steal everyone's money under the guise of some old outdated law that should be ripped up and flushed.
If 12dailypro is a Ponsi scheme then let's ask the SEC what Social Security is???? The government Social Security Ponsi scheme has been around years before the Ponsi scheme definition ever came into being. Thousands of dollars is taken out of my paycheck every year for Social Security, and I know I will never see a dime of it when I retire!!?? So there's a preceding legal precedant right there to this so called Ponsi scheme law for all you. Why doesn't someone have the guts to throw out this worthless Ponsi scheme law?? Because then the crooked lawyers wouldn't have a legal way to steal your money! Wake up people!!

You undermine your diatribe by not spelling "Ponzi" correctly.

If it wasn't for the fact that Ponzi schemes were illegal, then even more people would get ripped off.
